Market Economy and Competition Law

The market economy based on competition is the sole economic environment in which the price mechanism is able to operate effectively. Only in market economy based on competition is the price mechanism able to act as a signal by means of forming shadow prices and hence providing an effective distribution of resources. On the other hand market economy is not a system that develops naturally but rather one that is created. For a market, that has been formed according to this understanding to operate efficiently necessitates a competition law infrastructure which protects and develops this structure. An independent regulatory phenomenon that develops, regulates and supervises the competition law is an inseparable part of the system. Only with such an arrangement and regulatory understanding can competition and a market economy based on competition be formed and operated. Systems based on competition increase total factor productivity (TFP) by providing the optimal distribution of resources.
